GENERA's Terms and Conditions refer to any of the products and/or services it markets.
Customer's Obligations: The Customer is obligated to GENERA as follows: a) to deliver all material for designing, making, and developing the product, by the specifications and conditions of this order, within a maximum term of ten (10) days counted from the creation of the request. If the customer does not deliver the material within this term, GENERA may cancel the order; b) pay the value foreseen in the order as soon as the request is made.
GENERA's obligations: With the material received GENERA will execute the service for which this request is received, where its composition, layout and presentation, fonts, size, alphabetical order, and sections will be determined by GENERA, according to its knowledge and experience in the development, design, development, and placement of its different products, GENERA is committed to program, design, develop and structure the product. In addition, it will provide the client, where appropriate, the provision of hosting services.
Customer's warranty for delivered material: The customer warrants that all material used and provided to fulfill this order is not unlawful and does not infringe the intellectual property rights of any third party.
If for any reason the material delivered by the customer does not meet the requirements to be included, GENERA will inform the customer, to correct the issues, and send the appropriate material, within five (5) days maximum; otherwise the product will be developed, designed and developed in the best way at the discretion of GENERA.
GENERA will inform the customer via e-mail that its product can be consulted on the site provided by the company, so that in both cases within two (2) days following the sending of such communication the customer communicates in writing to GENERA that it approves the product or communicates corrections or changes to it. If no response is received from the customer within the deadline, it is assumed that the product has been approved. Once the product has been tacitly or expressly approved by the customer, GENERA shall not be liable for errors or omissions.
If the customer does not cancel its obligation within the term provided, GENERA reserves the right to cancel the publication order, remove the contracted product from the network, or to suspend the service, without prejudice to the collection of the appropriate value through any legal mechanism.
Disclaimer of Warranties: Where a technological product is involved, the functionality and advertising of the product specified in this order are dependent on system availability; GENERA does not warrant that its Internet site will operate without interruption or be error or virus free, nor is it liable in the event of interruption of its sites or for any errors occurring therein, nor for loss of data arising out of or due to the activity, management, and administration of the Internet access provider.
Limitation of liability: GENERA ASSUMES NO LIABILITY WHATSOEVER FOR ANY DAMAGES OF ANY KIND ARISING FROM THE PUBLICATION OF ADVERTISEMENTS, THE INABILITY OF THE SYSTEM, INTERRUPTION IN SERVICE, OR SERVICE FAILURES OR OUTAGES BEYOND ITS CONTROL, FOR WHICH IT AGREES TO USE ITS BEST EFFORTS TO RESOLVE. GENERA IS NOT RESPONSIBLE FOR ANY THIRD PARTY'S USE OF THE PRODUCT, CONTENT, OR INFORMATION THAT APPEARS ON ANY OF THE WEBSITES.
Exclusion of liability: regarding the content and services offered or provided on the client's portal, or in the published advertisement: GENERA has no obligation to monitor the content of the portals/advertisements of its clients or advertisers, and is advised that there is no link between GENERA and the advertiser. THEREFORE, GENERA ASSUMES NO LIABILITY WHATSOEVER FOR ANY DAMAGE OR INJURY OF ANY KIND THAT MAY BE DUE TO THE CONTENT OF ITS CLIENTS' OR ADVERTISERS' WEBSITES AND/OR ADVERTISERS' PAGES AND/OR ADVERTISEMENTS. IN ANY EVENT, CUSTOMER WILL DEFEND, INDEMNIFY AND HOLD HARMLESS GENERA IN THE EVENT ANY CLAIM OR SUIT IS ATTEMPTED RELATING TO THE CONTENT OR SERVICES OFFERED OR PROVIDED ON THE CUSTOMER'S ADVERTISEMENT/PORTAL.
GENERA reserves the right to reject at its discretion and when it deems appropriate, requests for the elaboration, design, and development of any type of product in the following cases: (a) when the respective requests have not been authorized by the persons who have the power to approve them; (b) when the content or information of the products is not truthful, or the content of the advertisements or Web pages that are advertised or published does not correspond to what is offered therein; c) when the products violate morals or good customs due to their content or presentation; d) when the products affect the rights of third parties, which may give rise to claims or give rise to legal proceedings for the use of other people's intellectual property, such as names, trademarks, drawings, texts, legends or commercial slogans, among others.
The amounts corresponding to this service order shall be paid in the manner agreed therein.
Acceptable Use Policy: In the case of a technological product. The CUSTOMER expressly agrees to abide by GENERA's policy concerning the use of products and services offered by GENERA. A copy of GENERA's current acceptable use policy can be consulted on the website: www.GENERA.ws, which may be modified at any time without prior notice to the CUSTOMER. In the event CUSTOMER does not comply with such acceptable use policy, GENERA ASSUMES NO LIABILITY FOR ANY DAMAGE OR INJURY OF ANY KIND WHATSOEVER.
Frame or link: for technology products on the Internet, GENERA will maintain a frame or link on the linked web page owned by the advertiser or customer; this frame or link is used for the functionality of the Portal and facilitates navigation on the Internet for users of the Portal. GENERA expressly states that it does not exercise any rights, nor does it intend to take advantage of the content provided by the owners of such Web pages. THE CUSTOMER EXPRESSLY AUTHORIZES GENERA TO MAINTAIN THIS FRAME OR LINK ON ITS WEBSITE.
Compliance with laws: Each party agrees to comply with all applicable laws, rules, and regulations, including any Internet regulations or policies and applicable laws, in the performance of this application.
Confidentiality: The information disclosed by the parties for cause or on the occasion of the request whether in verbal, written, or magnetic form that has the character of confidential shall be kept in this manner and for this reason, shall be protected. Consequently, neither party may communicate it to third parties or exploit it for commercial purposes and shall use the utmost diligence and good faith to preserve and maintain as confidential the information that it has received from the other party or that they have reciprocally communicated to each other.
Modifications: GENERA reserves the right to modify the features and functionality of operating systems, platforms and software.
Property Rights: GENERA will retain all proprietary rights in connection with the services and products it will use to deliver the Application; accordingly, all software, code, source, object, specifications, processes, techniques, concepts, improvements, discoveries, and inventions made or developed in connection with the platforms that generate the success of the Application will be owned by GENERA.
General Payment Conditions: Once the service order is received, it is understood that the payment was generated by the means indicated in the Web platform, therefore the respective invoice will be prepared according to the conditions established in the request.
Links. In cases where the technological product covered by this order corresponds to a link, the customer relieves GENERA of any liability related to any claim regarding the customer's site. Likewise, in these cases, GENERA reserves the right to remove the link if it considers that the content of the client's site violates the company's policies, terms of use, and legal notice.
Force Majeure: GENERA is not responsible for delays, errors, failures, interruptions, or disruptions in GENERA's network services or Internet site caused by any act, omission, or condition beyond GENERA's reasonable control, foreseeable or unforeseeable, including acts of God, strikes, lockouts, riots, acts of war, government regulations, fire, power failures, earthquakes, inclement weather, floods or other natural disasters or by actions to the hardware, software, equipment or telecommunications facilities of the customer or any third party.
Applicable legislation: For all purposes of this application, the applicable law shall be the law of the United States.

Explanation of what is "Acceptable Use Policy".

The purpose of this document is to establish the basis of the ''Acceptable Use Policy of the Service'' that customers must comply with depending on the services purchased from GENERA, being understood as Acceptable Use Policy: Rules that establish the use that can be made of the product or service delivered in a given area to be legal, ethical and responsible.

This Acceptable Use Policy specifies the actions prohibited to users who purchase a service from this platform, reserving the right to modify this policy at any time, being mandatory compliance with such modifications from the publication of the modified Acceptable Use Policy, so it provides easy access for customers to consult it.

GENERA will make every effort to ensure that the Acceptable Use Policy is respected and complied with by users/customers as basic rules that aim to preserve the goods, services and operation of the Internet Community, and expressly refrain from using the services for illegal and/or unethical purposes. This is intended to create a relationship of trust between the client/user and the operator as well as to achieve a safe use through the mandatory use of behaviors appropriate to the generally accepted rules of coexistence.

The fact of using any of the services offered by GENERA implies the acceptance of the terms of use and the client is expected to use the service with respect, courtesy, and responsibility, considering the rights of other users.

Actions expressly prohibited for each type of abuse

SPAM

GENERA prohibits its customers or users from using the e-mail it provides that affects, in any way, the following anti-spam usage provisions:

The falsification of the user or other information related to the sending of e-mails, including, but not limited to, the omission, deletion, falsification of the transmission of information, including headers, e-mail forwarding addresses, or Internet protocol addresses, or engaging in any activity or action to conceal or disguise the identity or contact information of the Customer, whether willfully or unwittingly, in the latter case undertaking to take all necessary steps to ensure that this does not occur.

If the Customer has a mail server, he must ensure that it is correctly configured to accept only mail from his domain, to prevent it from being exploited to send unsolicited e-mails. Mail servers that allow anonymous connections are not allowed. Likewise, it is forbidden to connect to anonymous mail servers without the owner's permission and if the Client has a Proxy server to share the connection, the Proxy server will not admit external connections because it would allow an external user to use this Proxy to send unsolicited e-mails pretending to be the client.

For serious or urgent reasons in the face of conduct that affects public order, social morality, current legislation, the rules of Internet courtesy, or that violates this Policy and/or otherwise seriously affects GENERA or its customers, GENERA may take appropriate action to address the consequences of such conduct.

Violations of Laws

Transmission, distribution, or storage of any material in violation of any applicable law is prohibited. This includes, without limitation, material protected by copyright, trademark and/or trade secret, copyright or other intellectual property right used without proper authorization, and material that is obscene, defamatory, xenophobic, constitutes an illegal threat, or violates export control laws.

Intrusion

Illegally access, without authorization or attempt to overcome security measures of computers or networks belonging to a third party, as well as any activity before the attack of a system to collect information about it, such as port scanning both voluntarily and unconsciously, committing the customer in the latter case to put the necessary means to prevent this from happening.

Hacking or similar activities

It is forbidden all those activities whose mission is illicit, unauthorized access, theft, blocking or damage of information, overloading or deterioration of services, systems, networks, and equipment with or without concealment of their identity, avoiding security measures if I will take them implemented, violating the conditions of use thereof, their rights recognized by law or laws. Likewise, the Customer agrees not to distribute information relating to the creation of malware on the Internet or to participate voluntarily in denial of service attacks.

Phishing

The Customer shall not knowingly store on his equipment any element that could constitute a fraudulent or fraudulent offense. In case of unconscious storage, the Customer undertakes to take immediate action to prevent access to the fraudulent page and to remove it as soon as possible. It must also put all the necessary means so that in the future a similar fact is not repeated.

GENERA ACCEPTABLE USE POLICY

GENERA will provide the necessary means for its customer to file a complaint or claim of abuse committed against it.

Response time for complaints will be as short as possible.

The customer, to ensure that the complaint reaches GENERA, must receive an Acknowledgement.

The customer will be provided with an identification of the complaint made.

Handling of all complaints.

The purpose of this policy for the protection of personal data is to comply with the provisions of Law 1581 of 2012, its regulatory decree 1377 of 2013 and other concordant rules that regulate the constitutional right of citizens to authorize the processing of their personal data, as well as to know, update and rectify the information that has been collected about them in the databases or files of public and private entities.

These policies and procedures apply to all personal data registered in person or virtually, directly or through third parties, in the databases of DESTINY CO S.A.S. and the companies or entities that are part of its organization (The Company), with the exceptions established by law, for its treatment (collection, storage, use, circulation or deletion), so that the owner of the data can access or may access any product, service, offer, promotion, benefit and/or link supported by a legal relationship with The Company.

DEFINITIONS

SENSITIVE DATA. These are data that affect the privacy of the Data Subject or whose improper use may generate discrimination, in the terms defined by law. This document establishes the purposes, measures and procedures that will govern the treatment of personal data within the company DESTINY CO S.A.S.

1. GUIDING PRINCIPLES FOR THE PROCESSING OF PERSONAL DATA

The Company will apply in a harmonious and comprehensive manner the following principles in the collection, handling, use, processing, storage and exchange of personal data:

f) PRINCIPLE OF ACCESS AND RESTRICTED CIRCULATION: Processing is subject to the limits derived from the nature of the personal data, the provisions of the Constitution, and the law. In this sense, the Processing may only be made by persons authorized by the Holder and/or by the persons provided by law; Personal data, except for public information, may not be available on the Internet or other means of dissemination or mass communication unless access is technically controllable to provide restricted knowledge only to the Holders or third parties authorized by this law;
g) SECURITY PRINCIPLE: The information subject to processing by the Data Controller or Data Processor referred to in the law, will be handled with the technical, human, and administrative measures necessary to provide security to the records avoiding their adulteration, loss, consultation, use or unauthorized or fraudulent access;
h) PRINCIPLE OF CONFIDENTIALITY: All persons in The Company involved in the processing of personal data that are not public, are obliged to guarantee the confidentiality of the information, even after the end of their relationship with any of the tasks included in the Processing, and may only supply or communicate personal data if they maintain a relationship with The Company and when it corresponds to the development of the activities authorized in this law and under the terms of the same.

3. TYPE OF INFORMATION SUBJECT TO OUR TREATMENT.

5. RIGHTS AND CONDITIONS OF LEGALITY FOR DATA PROCESSING.

5.1 RIGHTS OF THE OWNERS.The Holder of the personal data shall have the following rights:

a) To know, update and rectify their personal data concerning the Data Controllers or Data Processors. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading data, or data whose processing is expressly prohibited or has not been authorized;
b) Request proof of the authorization granted to the Data Controller, except when expressly exempted as a requirement for the Processing, by the provisions of the law;
c) To be informed by the Data Controller or the Data Processor, upon request, regarding the use that has been made of their personal data;
d) File before the Superintendence of Industry and Commerce complaints about violations to the provisions of this law and other regulations that may modify, add or complement it;
e) To revoke the authorization and/or request the deletion of the data when the Processing does not respect the constitutional and legal principles, rights, and guarantees, under the terms of the law and the jurisprudence that interprets it;
f) Access free of charge to your personal data that have been subject to Processing.

The right of suppression is not an absolute right. The Company may deny or limit the exercise of this right when:

a) The owner of the data has a legal or contractual duty to remain in the database.
b) The deletion of data hinders judicial or administrative proceedings related to tax obligations, the investigation, and prosecution of crimes, or the updating of administrative sanctions.
c) The data are necessary to protect the legally protected interests of the holder; to carry out an action in the public interest, or to comply with an obligation legally acquired by the holder.

5.4 PROVISION OF INFORMATION.

The requested information may be provided by any means, including electronic means, as required by the Data Subject. The information shall be easy to read, without technical barriers that prevent its access and shall correspond in its entirety to the information contained in the database.

5.5 DUTY TO INFORM THE HOLDER.

The Data Controller, at the time of requesting the authorization to the Data Subject, shall clearly and expressly inform him/her of the following:

a) The processing to which your personal data will be submitted and its purpose;
b) The optional nature of the answer to the questions asked, when they deal with sensitive data or with the data of children and adolescents;
c) The rights you have as Holder;

5.7 PROCESSING OF PERSONAL DATA.

Once the authorization of the respective holder(s) has been obtained, DESTINY CO S.A. will collect all the personal data of the holder(s) in a corresponding electronic database, which will be managed and stored by DESTINY CO S.A..

DESTINY CO S.A.S. will prevent unauthorized access by third parties to the personal data collected and will implement all measures aimed at their protection.

DESTINY CO S.A.S. undertakes to comply with its obligation to keep private data secret, as well as its duty to treat them confidentially and assumes the necessary technical, organizational, and security measures to prevent their alteration, loss, treatment, or unauthorized access, by the provisions of the law and international treaties signed by Colombia governing the matter.

The Holder shall be responsible, in any case, for the veracity of the data provided. DESTINY CO S.A.S. may exclude the holder who has provided false data from any relationship generated based on such false information, without prejudice to any other actions that may be appropriate.

TREATMENT OF SENSITIVE DATA. The Company will not process sensitive data, except when:

a) The Data Subject has given his/her explicit authorization to such Processing, except in those cases in which by law the granting of such authorization is not required;
b) The Processing is necessary to safeguard the vital interest of the Data Subject and he/she is physically or legally incapacitated. In these events, the legal representatives must grant their authorization;
c) The Processing is carried out in the course of legitimate activities and with due guarantees by a foundation, NGO, association, or any other non-profit organization, whose purpose is political, philosophical, religious, or trade union, provided that they refer exclusively to its members or to persons who maintain regular contacts because of their purpose. In these events, the data may not be provided to third parties without the authorization of the Data Controller;
d) The Processing refers to data that is necessary for the recognition, exercise, or defense of a right in a judicial proceeding;
e) The Processing has a historical, statistical, or scientific purpose. In this event, the measures leading to the suppression of the identity of the Data Holders must be adopted.

5.9 RIGHTS OF CHILDREN AND ADOLESCENTS.

Treatment will ensure respect for the prevailing rights of children and adolescents, under the guidelines of the law.

6. MECHANISM OF ATTENTION TO THE OWNERS OF THE INFORMATION.

To facilitate the protection of the rights of the holder(s) of the information, DESTINY CO S.A.S. establishes the following procedure for them:

6.1 Person or area responsible for the attention of requests: All requests, inquiries, and claims generated on the occasion of the processing of personal data shall be addressed to the main offices of DESTINY CO S.A.S. in Bogotá, as follows: correos_mercadeo@DESTINYCO.com or physically to the address Carrera 18 No. 79 A 42 Bogotá.6.2 Means of protection: In case the holder(s) of the information wish(s) to exercise any of their rights, they must send their request, explaining clearly, in detail, and precisely the reason for their requirement, the facts that support it, their contact information, the documents they wish to assert and their claim(s).

7. DUTIES OF DATA CONTROLLERS

In accordance with the Law, the following are duties of those responsible for the processing of personal data, without prejudice to the other provisions of the law:

a) Guarantee to the Data Subject, at all times, the full and effective exercise of the right of habeas data;
b) Request and keep, under the conditions provided by law, a copy of the respective authorization granted by the Data Subject;
c) Duly inform the Data Subject about the purpose of the collection and the rights he/she is entitled to by the authorization granted;
d) Keep the information under the necessary security conditions to prevent its adulteration, loss, consultation, use, or unauthorized or fraudulent access;
e) Ensure that the information provided to the Data Processor is truthful, complete, accurate, updated, verifiable, and understandable;
f) Update the information, communicate in a timely manner to the Data Processor, all developments concerning the data previously provided, and take other necessary measures to ensure that the information provided to it is kept up to date;
g) Rectify the information when it is incorrect and communicate the pertinent to the Data Processor;
h) To provide to the Data Processor, as the case may be, only data whose Processing is previously authorized by the provisions of this law;
i) To demand from the Data Processor at all times, respect for the security and privacy conditions of the Data Subject's information;
j) To process the consultations and claims formulated under the terms outlined in the law;
k) Adopt an internal manual of policies and procedures to ensure adequate compliance with the law and, in particular, for the handling of queries and complaints;
l) Inform the Data Processor when certain information is under discussion by the Data Subject, once the claim has been filed and the respective process has not been completed;
m) To inform, upon request of the Data Subject, about the use given to his/her data;
n) Inform the data protection authority when there are violations of the security codes and there are risks in the administration of the information of the Data Holders.
o) Comply with the instructions and requirements issued by the Superintendence of Industry and Commerce.

8. DUTIES OF DATA PROCESSORS.

Data Processors shall comply with the following duties, without prejudice to the other provisions set forth in this law and others governing their activity:

a) Guarantee to the Data Subject, at all times, the full and effective exercise of the right of habeas data;
b) Keep the information under the necessary security conditions to prevent its adulteration, loss, consultation, use, or unauthorized or fraudulent access;
c) Timely update, rectification, or deletion of data by the terms of the law;
d) Update the information reported by the Data Controllers within five (5) business days from its receipt;
e) To process the consultations and claims formulated by the Holders under the terms outlined in the law;
f) Adopt an internal manual of policies and procedures to ensure proper compliance with the law and, in particular, for the handling of queries and claims by the Data Holders;
g) Register in the database the legend "claim in process" in the manner regulated by law;
h) Insert in the database the legend "information under judicial discussion" once notified by the competent authority about judicial processes related to the quality of the personal data;
i) Refrain from circulating information that is being disputed by the Data Subject and whose blocking has been ordered by the Superintendence of Industry and Commerce;
j) Allow access to information only to those persons who may have access to it;
k) Inform the Superintendence of Industry and Commerce when there are violations of the security codes and there are risks in the administration of the information of the Data Holders;
l) Comply with the instructions and requirements issued by the Superintendence of Industry and Commerce.

PARAGRAPH. In the event that the qualities of Data Controller and Data Processor concur in the same person, he/she will be required to comply with the duties provided for each one of them.

The Company, in order to guarantee the rights of the data subjects, has agreed with its employees, who intervene in any phase of data processing, the obligation to safeguard confidentiality and limit the use of such information to the specific purposes for which they were collected.

9. PRIVACY NOTICE

The Company, through verbal or written communication generated by the Responsible, addressed to the Holder for the Processing of personal data, informs him/her about the existence of the policies of Processing of information that will be applicable, how to access them, the purposes of the Processing that is intended to be given to the personal data, the privacy of this information and, in general, will allow access to this document so that before his/her authorization, he/she can consult it.

These notices can be easily located by the Holder in the advertising material, on the Landing pages, on the web page, in emails, when accessing products or services, on invoices, in the registration forms for the collection of data necessary for contracting, invoicing, payment, etc.
